We are an online seller and these are the terms and conditions governing your access and use of Pestmatic along with its related sub-domains, sites, mobile app, services and tools (the “Site”). By using the Site, you hereby accept these terms and conditions (including the linked information herein) and represent that you agree to comply with these terms and conditions (the “consumer and visitor”). This consumer/visitor agreement is deemed effective upon your use of the Site which signifies your acceptance of these terms. If you do not agree to be bound by this User Agreement please do not access, register with or use this Site. This Site is owned and operated by Pestmatic. The Site reserves the right to change, modify, add, or remove portions of these Terms and Conditions at any time without any prior notification. Changes will be effective when posted on the Site with no other notice provided. Please check these Terms and Conditions regularly for updates. Your continued use of the Site following the posting of changes to Terms and Conditions of use constitutes your acceptance of those changes. By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. A breach or violation of any of the Terms will result in an immediate termination of your Services.
2. We reserve the right to refuse our services to anyone for any reason at any time. Credit card information is always encrypted during transfer over networks. 4. LIMITATION OF LIABILITY
Subject to applicable law, including with respect to liability for personal injury or non-waivable statutory rights under UK’s law, in no event shall Pestmatic or its employees, shareholders or agent(s) be liable to the user with respect to use of Site, the content or the materials contained in or accessed through the Site (including without limitation any damages caused by or resulting from reliance by a user or any information obtained from Pestmatic, or any damages that results from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operations or transmission or any failure of performance, whether or not resulting from acts of GOD, communication failures, theft, destruction or unauthorized access to Pestmatic records, programs or services and be liable to the user for any indirect, special, incidental, consequential, punitive or exemplary damages, including without limitation, damages for loss of goodwill, lost profits, loss theft or corruption of user information or the inability to use to Site or any of their features. The user’s sole remedy is to cease use of the Site.
5. CHANGES IN PRICES AND SERVICES
Prices for our products are subject to change without any prior notice. Pestmatic reserves the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
7. GOODS:
Pestmatic reserves the right to alter or change or review any details of products advertised without any prior notice and while every effort is made to describe goods accurately in the advertisement, no warranty is given as to accuracy and no responsibility shall be accepted for error which may result any loss.
8. COMPLAINTS:
We are committed to address any complaint very seriously. If you are dissatisfied in any way with our products or services we wish to know about it. We aim to respond as quickly as possible, positively and courteously to any complaints. Please contact us with any complaint you have and it will be directed to the concerned representative of the relevant department for further facilitation and corrective action. We have a well-trained and tenured staff for quality checking and packaging, our products are well packed in fragile packing so it’s not possible that our customer receives damage products, because we try to reduce the in-transit damages, however in some exceptional scenarios we facilitate valid complains of our customers as per process because our customers are important for us.
9. SHIPPING
Pestmatic uses Huboo Fulfillment center to fulfill our orders placed by the customers. Huboo Fulfillment centre packs and deliver the products to our valuable clients. Pestmatic delivers the order above £20 to one UK address free of charge. For orders below £20 carriage will be charged at the rate published for the service requested to one UK Mainland delivery address. We aim to dispatch all orders within 2 days (including weekends). Pestmatic delivers most of our products to the European countries; standard charges may apply for shipment outside the EU countries. Please contact our Customer Service for more information. Customer must ensure proper postal address and necessary information since deliveries can only be made to the correct postal addresses, following with a valid Postal Code. While receiving the order provided documentations must be signed by the receiver, if no one is available to sign at the time of delivery, a delivery card shall be left mentioning that the delivery was attempted and remained unsuccessful however another attempt shall be made the following day. A delivery will be attempted no more than three times, after which the goods shall be returned to the warehouse and a further delivery charges shall be claimed from customer. Pestmatic shall accept no responsibility whatsoever for circumstances arising from the failure of carrier to deliver goods or to deliver by an agreed time. Where it can be proved that the carrier was at fault, the only compensation that shall be paid will be the costs of the carriage.
10. RETURNS
In order to cancel the order you must follow the returns process/policy within 14 days of order receipt. Once your cancelation request is approved you can return the product back to us within further 14 days. Following the returns policy we only accept the returns on unopened and unused products. Please note that Pestmatic do not cover the cost of return postage unless the item is found faulty. Once we have received returned product and deemed it to be unopened and unused we will refund the product cost to the payment method used when the order was placed. If you have received an incorrect, damaged or defective item, or you received an item that does not match its description we will provide a pre-paid return postage label. Please be noted that return policy does not cover refunds of postage costs in any case. We will process the refunds of express delivery costs only if the order did not arrive within the specified timeframe, as long as there were no queries on the address or delivery access issues from the courier.

On the package include the reference number at the top line instead of Name (E.G. Huboo ref. **.) Include the huboo SKU sticker that the product arrives with inside the package, or on the product. Send it to:

Pestmatic can accept no responsibility for the incorrect usage of products and any damage this may cause as a result.
13. PRODUCT INFORMATION:
Most Pestmatic products displayed at the Site are available while supplies last. In some cases, merchandise displayed for sale at the Site may not be available in Pestmatic. The process displayed at the Site are quoted in British Sterling and are valid and effective only in the United Kingdom.
14. DISPUTE RESOLUTION:
You agree that all the matters relating to your access to or use of the site, including all disputes, will be governed by the laws of United Kingdom and laws without regard to its conflicts of law’s provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in the United Kingdom, and waive any objection to such jurisdictions or venue. The preceding provision regarding venue does not apply if you are a customer based in EU country you may make a claim in the courts of the country where you reside. Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. Claims made under the separate terms and conditions of purchase for goods and services are not subject to this limitation. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to cost and attorney’s fees. In the event of any controversy or dispute between Pestmatic and you arising out of or in connection with your use of Site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If you are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), the either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.
